1. Personal Information Collection SIW collects the following information when you register with SIW, when you make inquiries and when you request services from SIW: ?Your or your company’s ID, Password, Country, Company Name, Distributor Code, DSM Serial Number, Member Code SIW collects your personal information from the following channels: ?When you register with SIW on our Homepage ?Obtained from our business partners and other affiliated companies 2. Information Collection and its Use SIW takes your privacy seriously and collects and uses your personal information as minimal as possible for the following general purposes: ?Identify the user that willing to use SIW ?Administering the Membership of the Users ?Receive user’s request in relation to use of SIW SIW uses the collected information to verify the identification of the user registered with SIW as member, to prevent misuse and unauthorized use of the services, to ascertain the user’s intention to register, to limit the registration itself and to limit the frequency of the registration, to store registered information for possible dispute resolution, to entertain the complaints from the users, and to send out notices and correspondences to users. SIW collects certain specific personal information for the following respective purposes: ?ID and Password are used to verify the identification of the user registered with SIW as member and to prevent misuse and unauthorized use of the services ?Other selected personal/company information is used only for the purpose of providing services incorporating the user’s profession and interest, etc. You are not required to provide any other personal information of yours other than the required information specified herein and you will not be limited to enjoy all services SIW provides in any manner. SIW doesn’t use the collected information for any marketing purposes. 3. Users located in European Economic Area (“EEA”) For Users located in EEA, all processing of personal data is performed in accordance with privacy rights and regulations following the EU Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 (the Directive), and the implementations of the Directive in local legislation. From May 25th, 2018, the Directive and local legislation based on the Directive will be replaced by the Regulations (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, known as the General Data Protection Regulation (“GDPR”), and SIW’s processing will take place in accordance with the GDPR. 4. Providing your personal data to others We may disclose your personal data to Ssangyong Motor Company, with its principal office at 455-12, Dongsak-ro, Pyeongtaek-si, Gyeonggi-do, Republic of Korea insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy. Information about our group of companies can be found at www.smotor.com. In addition to the specific disclosures of personal data set out in this Section 4, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.[ We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. 5. International transfers of your personal data Your information that SIW collects when you register with SIW may be transferred to Republic of Korea. The hosting facilities for our website are situated in Republic of Korea. You acknowledge that personal data that you submit for publication through SIW may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others. 6. Consent to Collection and Use of your Personal Information SIW collects personal information as minimal as possible in a legitimate and fair manner for us to make service contracts with users and to perform the terms and conditions under such contracts made. SIW always requests your consent when we collect your information that is personally identifiable. In addition, when SIW collects personal information, SIW informs the users of the details about which information is collected, along with other terms and conditions, drawing the user’s attention to carefully read and consent to SIW’s privacy policy or agreement of use in order for the user to decide to use or cancel the services to be provided by clicking the CONSENT button or CANCEL button, respectively. Once you click the CONSENT button, you are considered to have consented to SIW’s collection of your personal information. 7. Consent to Use of Collected Information for other Purposes and Information Sharing to Third Party SIW does not use collected personal information beyond the scope stipulated under the privacy policy or share the collected personal information with 3rd parties including individual and companies under any circumstances unless you consented or the relevant laws and regulations provide otherwise. SIW only uses the collected personal information for other purposes or share it with 3rd parties upon notifying the user in advance through agreement of use, privacy policy, emails, or written correspondences of the nature of the use and sharing, i.e. with whom information is shared and its major line of business, specific information shared, and purpose of sharing. SIW may share the personal information of the users with others to develop new technology and improve services. Even in these cases, SIW obtains the user’s consent in advance fully informing the details about the 3rd parties to be shared with, why and what information is used, and how and until when such information is protected and maintained. Unless the user consents, SIW does not collect or share additional personal information arbitrarily. SIW does not share the personal information of the users with the advertisers even when SIW shows or sends advertisement to particularly targeted group based on gender and age. SIW only provides information in a form that is not personally identifiable even for the purpose of statistics, academic research, and market research. SIW may share the personal information of the users with others under your consent for the following circumstances: 1) SIW may provide the necessary information of the members with outside business partners who are assigned particular services and such assignment of services to the outside business partners will be found in the SIW’s privacy policy. The outside business partners will not use the personal information beyond the purpose of assignment or share with the 3rd parties. 2) For better services, SIW may create a business partnership with specialized contents business companies and various business partners to provide the users with tailored customer services, on-line advertisement services, on-line shopping mall services, user-driven web community services, paid contents services, mobile services, insurance, credit cards, telemarketing services, statistics and market research. 3) SIW provides and shares the necessary and required personal information of the members at its minimum with business partners only upon obtaining the consent from the members. In such case, SIW expressly discloses to the members about the business partners to be shared with, the purpose of such sharing and information to be shared. However, pursuant to relevant laws and regulations, it is possible for SIW to provide the personal information without the consent of the members under any of the following circumstances: 1) When the users consented to the disclosure of information in advance 2) When it is necessary to make a payment for service provided 3) When a user breaches certain terms and conditions under agreement of use or company policy 4) When there is sufficient ground for disclosure of the information in connection with taking legal actions against the users who were believed to have caused mental or monetary damage to others 5) When there is ground for disclosure of the information under the relevant laws and regulations (i.e. when SIW is requested by government agency or enforcement authority to provide such information in due courses under certain laws) 6) When the personal information is provided to the advertisers, business partners or research organizations for the purpose of statistics, academic research, and market research in a form that is not personally identifiable 8. Processing the Collected Personal Information through the Outside Information Processing Company SIW may process the collected personal information through an outside information processing company to improve services. In such case, SIW will notify the users and obtain user’s consent in advance. Furthermore, SIW makes sure that the outside information processing company is strictly bound by the terms and conditions including the protection of personal information provided, confidentiality and non-disclosure of the personal information to the 3rd parties, and information pocessing company’s liabilities under a written agreement with the information processing company which will be kept in a hard copy or in an electronic form. 9. Terms for Keeping and Use of the Collected Personal Information When a member does not want to continue her membership with SIW, the member may request by contacting SIW’s Customer Center, whereupon SIW will immediately out-process your membership with routine company outprocessing procedures. In addition, SIW will delete all customer information immediately after a member voluntarily dismisses herself from the membership with SIW. The previous member is always welcomed to re-register as member, but may not allowed to re-register with the identical ID which previously used. It is SIW’s policy to destroy the collected personal information of the members upon accomplishing the purpose of information collection in the following manner: ?Information obtained for registration of the membership: destroyed when a member desires to be out of the membership or involuntarily dismissed. ?Information obtained for payment: destroyed upon full payment or when statute of limitation runs out. ?Information obtained for delivery: destroyed upon acceptance of delivery ?Information obtained for polls and events: destroyed upon completion of such polls and events. However, the collected personal information is kept for a certain term under the following respective circumstances: ?Information regarding contract and cancellation of offer: 5 Years ?Information regarding payment and supply of products: 5 Years ?Information regarding customer’s complaints or dispute resolution: 3 Years In addition, even after the purpose for the collected personal information has been served, SIW may keep the personal information if there is ground to keep such information pursuant to Korean Commercial Act or related laws and regulations under the following circumstances: ?When there is ground to keep such information pursuant to Korean Commercial Act or related laws and regulations ?When the members were informed or agreed in advance in due courses ?When a member individually consented In principle, SIW destroys the related personal information immediately after the purpose of the collected information has been served. Your personal information obtained in the course of registration for membership will be kept for a certain period of time in accordance with SIW’s internal company policy and other related laws and regulations upon accomplishment of the purpose and then destroyed. The personal information mentioned above will not be used for other purposes except for its keeping permitted pursuant to the related laws and regulations. The collected personal information is destroyed in the following manner: ?information printed out on a paper: shredded or burned ?Information stored in an electronic form: destroyed in a manner that recovery of the deleted data is not warranted. 10. Right of the Users to Review and Modify their Personal Information The users may review and modify their personal information registered through the homepage of the SIW at any time and request for cancellation of their membership at any time. For review and modification of information, you log-in by typing your ID and Password into the MEMBERSHIP menu bar and you can change all other personal information except for ID and name of the user. When you forgot your Password, you click on “Forgot Password?” button and type in some required information. SIW will send out a temporary Password to your email account after verifying your identity. Although the users may cancel their membership or certain services, such cancellation does not terminate the rights to use all services, reserving the right to use services that do not require your ID. SIW may limit your ability to review and modify the personal information under the following circumstances: 1) When there is a concern that the life, property or interest of the users or certain 3rd parties may be conspicuously damaged 2) When there is a concern that ability of service providers to deliver services may be seriously compromised 3) When there is a violation of laws and regulations 11. Retention and Deletion SIW will not retain data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations. For data, SIW’s users have control of the purpose for collecting data, and the duration for which the personal data may be kept. Users with an active account will therefore have the responsibility to delete data when required. When a user’s account is terminated or expired, all personal data collected through SIW system will be deleted, as required by applicable law. 12. User’s rights In this Article 12, we have summarized the rights that you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights. Your principal rights under data protection law are: (a) the right to access; (b) the right to rectification; (c) the right to erasure; (d) the right to restrict processing; (e) the right to object to processing; (f) the right to data portability; (g) the right to complain to a supervisory authority; and (h) the right to withdraw consent. You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you an information of your personal data. You can access your personal data by visiting SIW website when logged into SIW. You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed. In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims. In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest. You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims. You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, we will cease to process your personal data for this purpose. You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest. However, this right does not apply where it would adversely affect the rights and freedoms of others. If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement. To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal. You may exercise any of your rights in relation to your personal data by written notice to us or by e-mail, in addition to the other methods specified in this Article 12. 13. Setting, Accepting and Rejecting the Cookies For customer-tailored services, SIW uses and accesses the cookies which store your information. A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web site's computers and stored on your computer's hard drive. The users are required to configure their browser to accept the cookies in order to enjoy the member services once they log on to the SIW’s website. SIW uses the cookies and searches the information on certain ID to provide more tailored and useful services to the users. The cookies recognize the computer of the user, but do not recognize the users individually. Using the cookies, SIW can conduct research on the services the users enjoyed, webpages the user visited and their patterns in use of services provided and ultimately can provide more convenient and optimal customer-tailored services. 14. Protection of Privacy for Child under Age 14 Under the current relevant laws in Korea, a child under age 14 is required to carefully review the privacy policy and get the consent from her legal guardian before she transmits her personal information to others on line. SIW fully explains the above-mentioned requirement through the agreement of use or company regulations for service use and verifies whether a child under age 14 has obtained the consent from her legal guardian at the very stage of registration. SIW sends out an email to the legal guardians and asks them to email back with their consent. The personal information of the legal guardians will be used only for the purpose of verifying their intention to consent. The legal guardians of the child under age 14 may request for reviewing and editing the information provided and withdrawing from their consent. Immediately upon request, SIW takes actions to honor such request. SIW does not share the personal information of child with any 3rd parties and prohibits its release until legal guardian’s request for correction of the specific personal information provided is fully entertained. All personal information of a child under age 14 will be destroyed immediately after 7 days of sign-in unless SIW obtains the consent from the legal guardian. 15. SIW’s Effort to Protect the Personal Information and Privacy SIW is making all the effort in handling the collected personal information to prevent it from being lost, inadvertently released, stolen, forged or damaged. SIW assures the users that their personal information is thoroughly being protected by secured Password. The users are the only parties who know their ID and Password and only the users are able to review and change the information with their Password. In this context, the users are advised not to let someone know their Password. It is also recommended that the users log out on line and close the browser when finished the Internet use. Especially when the users share the computer with others and use the Internet on a public venue such as company, school, library and Internet game business premises, the users should be more mindful of the recommendations stated above to protect the personal information. SIW also strives to protect the personal information of the members from being released or damaged by hacking and computer viruses. SIW regularly back-ups the data for possible loss, utilizes most advanced vaccine programs and adopts the algorithm using the password for secured transmission of the personal information on network. Furthermore, SIW uses firewalls to prevent unauthorized penetration into the system and tries to apply most advanced technology to create most reliable platforms for the users. SIW designates the persons exclusively in charge of the personal information and privacy of the users, imposes special Password which is regularly renewed and emphasizes the importance of observing the privacy policy by frequently educating the persons in charge. SIW further creates a very effective and responsive system under which when there are some questions raised concerning the SIW’s privacy policy and level of observance by the persons in charge, immediate actions are taken to rectify the problems through company’s internal task forces for privacy related matters. In addition, SIW establishes a screening system to minimize the scope of the personal information to be printed out by limiting the purpose of the print-out. SIW also requires a prior permission from the persons in charge of the personal information and privacy when employees proceed to make a data file of the personal information in an Excel or similar format. 16. Questions on Breach of Privacy Policy and Reporting SIW is owned and operated by Ssangyomg Motor Company registered in Republic of Korea with its principal office at 455-12, Dongsak-ro, Pyeongtaek-si, Gyeonggi-do, Republic of Korea. SIW is accepting questions and opinions concerning the protection of personal information and privacy of the users and establishing prompt feedback procedures for complaints from the users. The users are encouraged to report their complaints according to the followings, and the Officer of Privacy will reply with sufficient answers to your complaint. - Officer of Privacy: Sun-Jong Ahn - By post: 455-12, Dongsak-ro, Pyeongtaek-si, Gyeonggi-do, Republic of Korea (postal code: 17749) - By telephone: +82-31-610-1468 - By email: sunjong.ahn@smotoe.com The users may also report their complaints by contacting the following government agencies: - Korea Information Security Agency (http://www.cyberprivacy.or.kr) - KAIT (www.privacymark.or.kr) - National Police Agency (www.police.go.kr) 17. Officer in Chief and Officer in Charge for Privacy SIW is making all effort to make the users enjoy the good source of information in most secured manner. When there occur irregularities in connection with privacy contrary to all notices and policies made to the users, the Officer in Chief for Privacy of SIW will be liable for such irregularities. Responsibility related to security for the use of ID and Password is upon the users. Since SIW never directly asks about the user’s Password in any manner, the users should be especially mindful of any possible release of their Password to others. As stated earlier in the preceding Article 15 of “SIW’s Effort to Protect the Personal Information and Privacy” the users should be much sensitive to security when they use the Internet on a public venue. If there have been any addition, deletion or modification to the privacy policy of SIW, SIW will inform you via the “Announcement” of the SIW’s homepage before the changes become effective. Purpose The purpose of this Agreement of Use is to stipulate the rights, obligations and liabilities between SIW (“Company”) and the Members/Users regarding the use of general services and additional services provided by the Company. Article 2. Effect and Changes This Agreement shall become effective upon announcement through services the Users request. The Company may change the terms and conditions of this Agreement when there occur material grounds for change without any prior notice and the changed terms and conditions shall be announced through services the Users request. Members have the right to refuse the changes made to the terms and conditions of this Agreement. The Member may terminate his/her membership in the event that he/she does not consent to the changed terms and conditions. If a member does not request termination of membership within 10 days from the effective date of the agreement incorporating the changes, the member shall be deemed to have consented to the changes to the Agreement of Use. Article 3. Application of Other Laws The terms and conditions not stipulated in this Agreement shall be governed by Framework Act on Telecommunications, Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and other related laws and regulations. Article 4. Definitions The major terminology found in this Agreement shall be defined as follows: SIW Services (“Services”) shall mean a variety services provided to the Users by the Company or Company’s business partners or affiliates to the Users. The services may include services provided through SIW’s website and services provided severally or jointly with other companies. The nature of the services provided may be changed in accordance with the Company’s policy. Business Partners or Affiliates of SIW shall mean other companies which have contractual relationship with SIW to provide SIW’s services or other services. Websites of SIW shall mean websites designed and maintained by Company or Business Partners, providing services to the Users under this Agreement or other visitors. Member of SIW (“Member”) shall mean a User or Users who have been conferred ID upon entering a service agreement with the Company and the Member may log on and enjoy the features of the Website of SIW with an ID given to the Members at the time of registration. ID (“ID”) shall mean a combination of letters and numbers that Member designates and Company approves, used for verifying the identification of the Member and enabling the Member to use the services the Company provides. Password shall mean a combination of letters and numbers the Member designates, verifying the Member who has been given an ID and protecting the privacy of the Member. Suspension of Use shall mean limiting the Member’s use of services pursuant to the Agreement of Use. Cancellation of Services shall mean that Company or Member terminates the agreement of use upon receipt of services. Payment shall mean activities of paying certain amount of fees or money via various means including credit cards and cell phones for the use of paid services on Websites of SIW or for the purchase of products. Refund shall mean returning the amount already paid either in cash or credit pursuant to ⑥ of Article 15 of this Agreement . Chapter 2. Agreement of Use of Services Article 5. Entering the Agreement of Use The Member shall be deemed to have consented to this Agreement of Use by clicking
button at the time of registration or at the time of announcement of changes to this Agreement of Use. This Agreement of Use shall be entered and made upon Company’s accepting the request for use of services from the Member who have consented to the Agreement of Use. Article 6. Request for Services The Member who wishes to use services shall request services by providing his/her personal information the Company requires. Article 7. Acceptance of Request for Services ① The Company shall accept the request for services made pursuant to Article 6 of this Agreement in the order it receives unless there is reasonable ground not to accept. ② In the event that any of the followings applies, the Company may elect to limit its ability to accept the request for services or reserve its acceptance until the grounds for non-acceptance are cured: 1. In the event that Company’s systems to provide services cannot render further services 2. In the event that there are technical malfunctions 3. In the event that the Company sees it required ③ The Company may not accept the request for services if Company acknowledges any of the followings: 1. In the event that a User failed to use his/her own name at the time of registration 2. In the event that a User used the name of others 3. In the event that a User provided false statements concerning the required information at the time of requesting services. 4. In the event that a User made a request for service with intent to jeopardize the welfare and order of society and culture. 5. In the event that Company believes that a User failed to meet certain requirements for service request. ④ The Company shall notify the User when it elects not to accept the request for service or reserve its acceptance pursuant to ② and ③ of this Article, provided that Company may not notify the User in the event that Company finds it impossible to notify with no fault of the Company. Article 8. Protection of Personal Information ① Company shall protect and respect the personal information of the Member. ② Company shall collect the personal information of the Members provided at the time of registration and through web-community activities, participation in the various events and promotions and other use of services. The collected personal information shall be used for the purpose of performing the terms and conditions and delivering the services under this Agreement. ③ Company shall not disclose or release the collected personal information of the Member to 3rd parties and shall not use it for commercial purposes except for any of the following circumstances: 1. When it is required to settle the payment of the fees for the services provided. 2. When such personal information is used in a form that is not personally identifiable for statistics, academic research or market research. 3. When a government agency requests such personal information for investigation in accordance with the related laws and regulations. 4. When other laws and regulations permit the disclosure or release of such information. 5. When the Korea Internet Safety Commission requests in accordance with the relevant laws and Regulations. ④ Within the scope stipulated in the preceding ③ of this Article, Company may make and use a collective data containing the collected personal information of the Member or Members consistent with the nature of the business of the Company. Company may set the cookies into the computer of the Member. In such case, the Member may reject the cookies and configure the browser to signal the reception of the cookies. ⑤ Company may keep the personal information provided at the time of registration up to 60 days after the date of cancellation of this Agreement except for the following circumstances: 1. When there is necessity to keep such information in accordance with the laws protecting the consumers such as the Commercial Act and Electronic Commerce Act. 2. When a Member caused problems through his/her unsound use of services, Company may temporarily keep the personal information of the Member for one year for the purpose of protecting the other Members and cooperating with government enforcement authority. ⑥ It is recommended that the Member should refer to the Privacy Policy of the Company for details. Article 9. Use of Personal Information ① The personal information Company collects shall be at its minimum for providing services and Company may request more detailed personal information as Company sees it fit. ② Company may share the personal information with 3rd parties with the consent of the Users under any of the following circumstances. Even in this case, information sharing shall be made possible only under the consent of the Users. 1. Company may provide with the personal information to paid service providers, and delivery companies for the purchase of the products, paid services, and delivery of the promotional items and prizes, respectively. 2. Company may provide the personal information of the Users who participated in various events or promotions featured on the Website of Company with the hosting companies of such events and promotions. ③ Company may provide the necessary and required personal information of the Members with some outside business partners for particular services assigned under the consent of the Members, informing the Members of such assigned services to the outside business partners. The outside business partner shall not use the personal information of the Members for any other purposes and shall not share such information with other 3rd parties. ④ Company may make a contractual partnership with other specialized contents business companies or business partners to provide better services including customer-tailored services, web-based community services, paid contents service, mobile services, insurance, and credit cards. ⑤ Company may provide or share the personal information of the Members with the business partners under ④ of this Article as minimal as possible upon obtaining the consent from the Members and shall inform the Members of the detailed nature of such information sharing such as with whom, what and how such information is shared (name of business partners, purpose of sharing, and personal information shared). ⑥ Company may obtain the consent from the Users by making an special announcement to the Members when Company uses the personal information of the Members as mentioned under the ③ - ④ of this Article. ⑦ The Members may withdraw their consent to the use of the personal information provided to the Company at any time and such request for withdrawal from their consent shall be deemed to have cancelled this Agreement of Use. Article 10. Changes to the Personal Information ① The Member may review and edit his/her personal information via
menu at any time. ② The Member shall edit his/her personal information provided at the time of registration on-line if there have been changes and the Company shall not be liable for any damage incurred due to the Member’s failure to edit such changes. ③ The Member may withdraw his/her consent to the use of personal information if he/she desires, whereupon the Company may limit the ability of the Member to use the services Company provides. Withdrawal from the given consent shall be deemed to have cancelled this Agreement of Use. Chapter 3. Obligations of the Parties Article 11. Obligations of Company ① Unless stipulated otherwise, Company shall be obligated to provide the requested services from a Member on the same day of such request. ② Company shall continuously make all effort to provide continuous and reliable services provided pursuant to this Agreement of Use and shall make immediate repair for abrupt breakdowns or damage to the system. However, Company shall be entitled to temporarily suspend or stop providing the services at the time of emergency or Act of God. ③ Company shall, through established procedures, process the complaints or suggestions which were made in due courses from a Member if such complaints and suggestions are considered to be legitimate. Company shall notify the Member of the reasons for delays and time schedule in the event that processing the complaints and suggestions may take certain period of time. ④ Company shall abide by all conditions related to the protection of privacy as stipulated in the Article 8 of this Agreement and SIW privacy Policy. ⑤ Company shall be obligated to guide the Members during the courses of entering an agreement of use, changing the terms and conditions and canceling the agreement. Article 12. Obligations of the Members ① The Member shall abide by the terms and conditions of this Agreement and other announced requirements from the Company and shall not interfere with any and all businesses of the Company. ② The Member shall be responsible for their ID and Password. All liabilities incurred out of the Member’s negligence and misuse shall be upon the Member. ③ The Member shall report any misuse or unauthorized use of the ID and Password to the Company immediately upon his/her acknowledgement. All damage incurred to the Member due to his/her failure to report shall be borne by the Member. ④ The Member shall not do business using the services the Company provides without Company’s prior consent and Company shall not be liable for any damage or outcome caused by unconsented business conducted by the Member. The Member shall indemnify the Company from all damages and liabilities incurred out of the unauthorized business activities of the Member. ⑤ Unless obtained an express consent from the Company, the Member shall not transfer, assign, inherit, or mortgage his/her privileges to the use of services or contractual status to others. ⑥ The Member shall not act any of the followings in connection with the use of the services: 1. Misuse or unauthorized use of the ID, Password of the other Members 2. Unconsented copying, publishing, broadcasting and sharing the information obtained in the course of using the services beyond the scope of use stipulated in this Agreement. 3. Circulating emails or similar medium which contain certain content of infringement of the intellectual property rights of others 4. Circulating and transmitting obscene and provocative materials via emails or similar medium to others. 5. Circulating and transmitting certain harassing and threatening materials to violate the privacy of others via emails or similar medium to others 6. Certain acts objectively believed to associated with crime 7. Collecting and storing the personal information of others without the Company’s consent 8. Any other acts in violation of other relevant laws and regulations Chapter 4. Use of Services Article 13. Scope of Use of Services The Member shall be entitled to use all of the Company’s services with the ID issued at the time of registration. Article 14. Providing Information Services ① Company may provide a variety of information believed to be required for the Member’s use of services by way of announcements or emails. ② Company may provide service-related information including but not limited to membership cards via telephone, announcement or emails to give more benefits to the Members. Provided that the Company shall exclude the Members who have clearly expressed their intention not to receive such service-related information to the Company. In such case, the Company shall not be responsible for any detriment incurred to the Members. Article 15. Paid Services, Payment and Refund ① The services provided by the Company shall consist of Free Services and Paid Services. The Members shall pay the listed fees for the Paid Services provided by the Company and its business partners. ② The Paid Service provided by the Website of Company shall include “Membership Type Paid Service” in which the Member may use the services for certain period of time upon his/her payment. ③ The Paid Service provided by the Website of Company shall be named as “Premium Services.” ④ The Premium Services shall be paid by any of the following payment methods: 1. By Credit Card 2. By Wire transfer 3. By Cell phone 4. By Phone Bills 5. By Telephone 6. By ARS 7. Other payment methods the Company elects ⑤ The service fees for the Premium Services shall be refunded under any of the following circumstances: 1. When refund is requested within 1 day after payment 2. When the fee was paid twice for the same service due to system malfunction 3. When there occur unavoidable occasions Company recognizes, such as system breakdowns and malfunctions ⑥ The refund shall be made according to the methods of payment the Member elected. 1. Cancellation of transaction for the payment by credit card 2. Refund in cash for the payment by wire transfer, cell phone, phone bills, telephone or ARS ⑦ Detailed terms and procedures for other refunds and cancellation of payment not stipulated in this Article shall be in accordance with the Company’s regulations for operations. ⑧ The request for refund or personal information based on the misuse of the personal information of the Members and fraud in payment shall be made only through government enforcement agency. Article 16. The Information and Materials Member Uploaded The Company may delete the information and materials the Members uploaded without a prior notice to the Member if any of the followings are believed to be applied: 1. The information and materials harassing and slandering the other Members or 3rd parties 2. The information and materials violating public order and culture 3. The information and materials constituting criminal acts 4. The information and materials interfering with the rights of others including the copyrights of Company and the 3rd party 5. The information and materials beyond expiration date and beyond the capacity of the system 6. The information and materials which portray obscenity and linked to pornographic websites. 7. The information and materials which are inappropriate to the nature of the bulletin board. 8. The information and materials believed to be in violation of other relevant laws and regulations Article 17. Copyrights of the Information and Materials The following shall stipulate the rights regarding the information and materials uploaded: 1. The rights and liabilities on the uploaded information and materials shall be upon the Members who uploaded and the Company shall not use such uploaded information and materials for business purpose without the consent of the Members. Provided that Company may use such uploaded information and materials for non-profit purpose and shall not be entitled to any interest and ownership in the information and materials in question. 2. The Member shall not use the uploaded Information and materials for any business purposes. i.e. selling or restructuring the information and materials. Article 18. Advertisement and Relationship with the Advertisers ① Company’s profits to provide the services may be partially derived from advertisement. In such case, the Members who wish to use the services the Company provides shall be deemed to have consented to the showing of advertisements by using the services. ② Company shall not be liable for any damage or loss incurred out of the marketing efforts of the advertisers while the Members are participating in or responding to the advertisers’ business marketing. Article 19. Time for Use of Services ① Unless there are special business concern or technical problems, the Member shall use the services 24 hours a day throughout the year without holidays. Provided that the Company may designate some definite days if the Company believes it necessary and required such cases as the system check-ups during which time the Company may not provide services. ② Company may designate the time for respective services provided by dividing the scope of services. In such case, the Company shall notify the Members in advance. Article 20. Liabilities for Use of Services The Member shall not sell any products, using the services the Company provides unless an authorized officer of the Company permits in writing. The Member shall not be permitted any business activities through hacking, advertisement for profits, pornographic sites and shall not distribute unauthorized commercial software. The Company shall not be liable for any and all damage, loss, or legal actions including arrests arising out of the Members’ violation of the preceding paragraph of this Article. Article 21. Suspension of Services ① Company may suspend services under any of the following applies: 1. Unavoidable and required repair of the system for services 2. Suspension of telecommunication services by telecommunication companies defined under the Telecommunication Business Act. 3. Other grounds constituting Force Majeure ② Company may limit or suspend partial or entire services when providing normal services is severely compromised due to national emergency, power outage, breakdowns of systems and/or overloads of service requests. ③ Company shall immediately notify the Members of the reasons and time line for non-service when the Company shall intend to limit or suspend its services pursuant to the preceding ① and ② of this Article. Chapter 5. Agreement of Use of Services Article 22. Cancellation of Agreement and Limitation of Use of Services ① When a Member intends to cancel the agreement of use of services, the Member shall request withdrawal of membership from the Company on-line. ② Company may cancel the agreement of use of services or suspend the services for a definite period time without a prior notice if any of the followings applies: 1. When a Member misuse the personal information, ID or Password of others 2. When the name of a Member is not the real name of the Member 3. When a Member defames or causes detriment to others 4. When a Member infringes the intellectual property rights of the Company, the other Member or 3rd parties 5. When a Member intentionally circulates information or materials to damage the public order and culture 6. When a Member plans to use or actually uses the services with intent to damage national interest or public goods 7. When a Member deliberately interferes with the management of services of the Company 8. When a Member transmits heavy volume of information or commercial information with intent to interfere with ordinary operation of services of the Company 9. When a Member circulates computer viruses causing malfunction of systems or destruction of information 10. When a government agency such as the Korea Internet Safety Commission requests a rectification of an act of a Member or the National Election Commission issues an authoritative construction on certain act of a Member 11. When a Member replicates, circulates, or uses for commercial purpose the information obtained from the use of services of the Company without any prior consent from the Company 12. When a Member uploads certain obscene materials on his/her homepage or bulletin board or links pornographic sites 13. When a Member does not log in into the Website of the Company in most recent 3 months 14. When a Member violates the terms of use of services the Company elects including this Agreement of Use ③ Company shall immediately entertain the request of re-using the ID of the Member within 1 month from the last day of the suspension of services. Absent such request for re-use of the ID within the 1 month, the Member shall be deemed to have no intention to continue the use of services, whereupon the Company may cancel the Agreement of Use. Chapter 6. Damages and Miscellaneous Provisions Article 23. Damages Company shall not be liable for any damage to the Members arising out of using the Free Services. For the Paid Services, respective and separate agreement of use per services shall apply. Article 24. Waiver of Liabilities ① All liabilities of the Company shall be waived for non-delivery of services due to Act of God or Force Majeure. ② Company shall not be liable for non-delivery of services caused by the fault of the Member. ③ Company shall not be liable for any and all loss of expected interest or any and all damage from the information or materials obtained over the course of using services of the Company. ④ Company shall not be liable for the information, material, and source the Members uploaded and for its trustworthiness or accuracy. ⑤ Company shall not be liable for any and all damage caused by willful and negligent acts of the Members committed while using the service of the Company. Article 25. Jurisdiction When there are disputes or legal actions over the use of services, the Company and the Members agree that they shall submit to the exclusive jurisdiction of the competent courts governing the principal place of business of the Company. Addendum (Effective Date) This Agreement of Use shall be effective May 25, 2018 Effective May 25, 2018, this Agreement of Use shall apply to the Members registered under the previous Agreement of Use.
